Terms and Conditions — SMS Messaging Service

By opting in to receive SMS messages from Clarity Physician Partners (“we,” “us,” “our”), you agree to the following terms and conditions. Please read them carefully before providing your consent.

 

1. SMS Messaging Service

By providing your phone number, you consent to receive SMS text messages from Clarity Physician Partners. Messages may be sent from the following number:

Our SMS messaging service includes two categories of messages:

 

A. Transactional Messages (Informational)

These messages are sent to support your care and include:

• Appointment reminders and scheduling confirmations

• Follow-up care communications and check-in prompts

• Practice announcements and service updates

• Responses to your inbound messages (two-way communication)

 

B. Marketing and Promotional Messages

With your prior express written consent, you may also receive:

• Educational content related to menopause, metabolic health, and wellness

• Promotional messages about available services, events, or resources

 

You may consent to transactional messages only, or to both transactional and promotional messages. Consent to receive promotional messages is not a condition of purchasing any goods or services from Clarity Physician Partners.

 

2. Message Frequency

Message frequency varies based on your appointment schedule and communication preferences.

3. Message and Data Rates

Standard message and data rates may apply based on your mobile carrier’s terms and your individual wireless plan. Clarity Physician Partners is not responsible for any charges incurred from receiving SMS messages.

 

4. SMS Messages Are Not Medical Advice

SMS messages from Clarity Physician Partners are for informational, scheduling, and general communication purposes only. They do not constitute medical advice, a medical diagnosis, or a treatment recommendation.

 

Clinical communications — including care plans, treatment recommendations, lab results, and medical guidance — are delivered exclusively through our secure messaging platform and telehealth consultations, not via standard SMS.

 

If you have urgent or emergency symptoms, call 911 or go to the nearest emergency room. SMS messaging is not monitored for emergencies and should never be used for urgent medical needs.

 

5. Privacy Policy

Your personal information, including your phone number, will be handled in accordance with our Privacy Policy, available at https://clarityphysicianparters.com/privacy

 

We do not sell, rent, or share your phone number or personal information with third parties for their marketing purposes. Your information may be shared with service providers who assist us in delivering SMS messages (such as our practice management platform and SMS delivery providers), solely for the purpose of operating this service.

 

 

6. Opt-Out Instructions

You may opt out of receiving SMS messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a single confirmation message confirming your removal. You will not receive further SMS messages from Clarity Physician Partners unless you re-subscribe.

Note: Opting out of SMS messages does not cancel any appointments, affect your patient status, or terminate your relationship with Clarity Physician Partners. It only stops text message communications.

 

7. Consent and Eligibility

By opting in, you confirm and represent that:

• You are the owner or authorized user of the phone number provided.

• You are at least 18 years of age.

• You agree to receive SMS messages from Clarity Physician Partners as described in these Terms.

• You understand that consent to receive promotional messages is not a condition of purchasing any goods or services.

• You understand that message and data rates may apply.

 

Your consent to receive promotional messages constitutes your “prior express written consent” under the Telephone Consumer Protection Act (TCPA) and applicable state laws. You may revoke this consent at any time by following the opt-out instructions in Section 6.

 

8. Limitation of Liability

Clarity Physician Partners is not liable for any charges, errors, delays, or failures in SMS delivery caused by your mobile carrier, third-party service providers, network outages, device incompatibility, or circumstances beyond our reasonable control.

 

SMS messages are provided on an “as-is” basis. We make no warranties, express or implied, regarding the reliability, timeliness, or accuracy of messages delivered via SMS. In no event shall Clarity Physician Partners be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the SMS messaging service.

 

9. Modifications to These Terms

Clarity Physician Partners reserves the right to modify these Terms and Conditions at any time. Updated terms will be posted on our website and/or communicated via SMS. Your continued receipt of SMS messages after any modification constitutes acceptance of the updated Terms. If a material change is made, we will make reasonable efforts to notify you in advance.

 

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of New York State.
